Le eventuali dichiarazioni rese al curatore nell’esercizio delle sue funzioni e trasfuse nella relazione e allegate alla stessa sono pienamente utilizzabili come testimonianza indiretta, diventando quindi parte integrante degli accertamenti eseguiti dal curatore medesimo nell’esercizio dei poteri assegnatigli per verificare le cause del dissesto (Trib. Milano, sez. III pen., sent. n. 607\/2019).<\/p>\n

\u201cE\u2019 utilizzabile, quale prova a carico dell\u2019imputato, la testimonianza indiretta del curatore fallimentare sulle dichiarazioni accusatorie a lui rese da un coimputato non comparso al dibattimento, e trasfuse dallo stesso curatore nella relazione redatta ai sensi dell\u2019art. 33 l. fall.\u201d (Cass. pen., sez.
